1. Acceptance of Terms

By accessing or using the Presency platform ("the Platform"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Use License

Presency grants you a non-exclusive, non-transferable, revocable license to use the platform to build and host commercial storefronts. You may not:

• Modify or copy the core platform code.
• Use the platform for any illegal purpose or to sell prohibited items.
• Attempt to decompile or reverse engineer any software contained on the platform.
• Remove any copyright or other proprietary notations from the materials.

3. Account & Subscriptions

Storefronts are subject to recurring subscription fees. Failure to maintain an active payment method will result in site suspension. Presency reserves the right to terminate accounts that violate our community standards or engage in fraudulent activity.

4. Content Ownership

You retain all rights to the content you upload to your storefronts (logos, copy, product data). By using the platform, you grant Presency a limited license to host and display this content on your behalf.

5. Marketplace & Independent Vendors

Presency is a marketplace platform. Product listings, prices, descriptions, images, and availability on storefronts hosted through Presency are created and maintained by independent vendors (“Store Owners”). Presency does not verify the accuracy of all listings and does not guarantee that any product description, price, or image is complete, current, or error-free.

Store Owners are solely responsible for their listings, inventory, pricing, fulfillment, delivery, returns, refunds, and customer communications. Presency is not the seller of record for products listed on individual storefronts unless explicitly stated otherwise.

6. Purchases on Storefronts (Buyers)

When you purchase from a storefront powered by Presency, you are buying from the Store Owner operating that site, not from Presency directly. You agree to review product details, pricing, shipping or pickup terms, and store policies carefully before completing a purchase.

Disputes about product quality, delivery, cancellations, or refunds should be directed to the Store Owner in the first instance. Presency may, at its discretion, assist with platform-related payment or technical issues but does not act as an arbiter of buyer–seller disputes unless required by applicable law.

7. Payments & Payouts

Checkout payments on storefronts are processed through third-party payment providers (including Paystack). By paying, you authorize the payment provider to charge your selected payment method for the order total shown at checkout.

Presency facilitates payment collection and may route funds to Store Owners according to platform rules and applicable fees. Payments are not held in escrow pending buyer confirmation of delivery unless a specific storefront feature explicitly states otherwise. Store Owners receive payouts according to Presency's settlement schedule and their configured payout settings.

Presency is not responsible for delays, failures, or reversals caused by payment providers, banks, or incorrect payout details supplied by Store Owners.

8. Disclaimer

The materials on Presency's platform are provided on an 'as is' basis. Presency makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.
